1. Scope and Acceptance of the Terms
These Terms of Service (hereinafter "TOS") are agreed upon by Alexis Sartre, French sole trader (SIRET 108 062 498 00010, the Publisher) and any physical or legal person wishing to purchase a plan or subscribe to the service on the Triday website (the User or the Customer).
Any purchase or subscription of a plan via the Triday website implies the Customer's unconditional acceptance of these TOS. The Publisher reserves the right to modify these TOS at any time. The applicable conditions are those in force on the date of the order.
2. Presentation of the Service
Triday is a mental, logistical, nutrition, and pacing planning tool for athletes practicing endurance sports (specifically middle and long-distance triathlon). The service allows simulating, generating, and tracking personalized race plans (including nutrition timing and physical intensity targets).
Access to the web application requires a stable internet connection. The application also integrates local caching features to enable access to certain elements offline.
3. Pricing and Plans
The prices of Triday services are indicated in Euros (€) including all taxes (TTC). The Publisher reserves the right to modify its prices at any time, but the price shown on the site on the day of the order will be the only one applicable.
Triday offers two main pricing options:
- Single Race Plan Purchase: Billed at a rate of €9 (incl. taxes) per plan. This option unlocks all premium features for a single specific race (with history and edits preserved for 12 months).
- Annual Subscription: Billed at a rate of €39 (incl. taxes) per year. This subscription grants unlimited creation and management of premium race plans for the entire duration of the subscription. Unless cancelled by the user prior to the billing date, the annual subscription automatically renews for successive one-year periods.
4. Ordering and Terms of Payment
The Customer completes their order online by selecting the desired purchase option (single plan or annual subscription) after creating an account.
Payments are fully secure and processed via credit card (Visa, Mastercard, American Express, etc.) through the specialized provider Stripe Inc. (Stripe Payments Europe, Ltd.). Triday does not store any banking details on its servers. Payment is due immediately upon ordering.
5. Cancellation and Right of Withdrawal
In accordance with EU consumer protection regulations (Article 16(m) of the Consumer Rights Directive 2011/83/EU) and local consumer codes, the right of withdrawal does not apply to contracts for the supply of digital content not delivered on a tangible medium, if the performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.
By completing a purchase (generating the race plan or activating the annual subscription), the Customer gives their express consent to the immediate commencement of the service and expressly waives their 14-day right of withdrawal. No refunds will be issued once the digital content is unlocked or the service is activated.
6. Sports & Medical Disclaimer
Triday provides pacing estimates, hydration management, and carbohydrate/sodium targets based on general sports physiology principles and user-declared parameters.
These recommendations are for informational purposes only and do not substitute for:
- Personalized medical advice or follow-up from a physician or cardiologist;
- Individualized coaching and expertise of a certified sports coach;
- The athlete's own physical sensations during physical effort.
The Customer is solely responsible for ensuring they are in physical condition to participate in events and for adapting their nutrition to real-time conditions. The Publisher cannot be held liable for injuries, physical failures, or other incidents occurring during preparation or the race.
7. Intellectual Property
The purchase of a race plan or subscription only grants a personal, non-exclusive, and non-transferable license to use the Triday application. Sharing accounts or reselling generated plans is strictly prohibited.
8. Governing Law and Disputes
These TOS are governed by French law. In the event of a dispute, the Customer should seek an amicable solution by contacting technical support at contact@triday.fr. If no amicable solution is reached, the dispute will be submitted to the competent courts.
